Buying property in Czechia as a foreigner: the 2026 process
Foreign nationality generally does not prevent a Czech property purchase, but residence status, financing, document language, ownership type and payment controls still matter.

You can generally buy Czech real estate without Czech citizenship or residence. That does not make the transaction identical for every buyer. Your legal capacity, sanctions status, source of funds, documents, marital property regime, mortgage underwriting and intended residence all require separate checks. Start with the property and contract, not an online claim that a passport either guarantees or prevents the purchase.
Who can buy, and what
Current official gov.cz guidancestates that, in principle, any individual may purchase and sell immovable property regardless of nationality, and foreign legal entities may also acquire it. This general rule is more reliable than old embassy pages that still describe repealed foreign-exchange restrictions.
“In principle” still matters. Capacity rules, court approval for a buyer without full legal capacity, sanctions and anti-money-laundering controls, property reserved by special law, restrictions on the seller’s power to transfer and the particular ownership structure can change a transaction. Have Czech counsel check your buyer identity and the specific asset instead of relying on a historical “since 2009” shortcut.
Ownership is not a Czech residence permit
Buying a home and obtaining permission to enter or live in Czechia are separate legal questions. Title registration does not itself create a visa, temporary residence or permanent residence right. Check the official Interior Ministry residence routesfor your nationality and purpose of stay before treating a purchase as an immigration solution.
The process, step by step
- Reservation contract (rezervační smlouva) — identify every party and payment recipient, then make financing and unresolved due diligence explicit conditions rather than relying on a verbal promise that the fee is refundable.
- Cadastre check (výpis z katastru nemovitostí) — the title extract shows registered ownership, mortgages, easements, restrictions and pending-change markers. Pull the current record and underlying documents with your lawyer before signing and before release.
- Purchase and escrow contracts (kupní smlouvaand úschova) — use your own Czech transaction lawyer, obtain a translation you understand and make price release depend on objective cadastral evidence and the permitted title state.
- Cadastre registration — ownership of registered real estate is acquired by registration, not merely by signature or payment. Current ČÚZK guidancestates that an entry proposal generally costs CZK 2,000 and cannot be permitted before the statutory 20-day protection period has run. That is a minimum safeguard, not a promised completion date.
What it costs
Current official tax guidanceconfirms that Czech real-estate acquisition tax was abolished, so it is not added to the purchase price. Do not replace it with a generic percentage budget. Obtain written quotes for your lawyer, escrow, certified signatures, translations or interpreting, technical inspection, valuation, mortgage, cadastral filing and any buyer-paid brokerage fee actually stated in your contracts. Mortgages are the real friction point
Legal eligibility to buy is not the same as being able to finance it locally. Each lender decides which residence statuses, income countries, currencies, documents and collateral it accepts. Do not rely on a universal “foreigners need 40–50%” rule or assume a Czech guarantor cures every case.
The current CNB frameworksets a maximum LTV of 80%, or 90% for applicants under 36 purchasing owner-occupied housing. From 1 April 2026 the CNB also recommends LTV 70% and DTI 7 for defined investment-home purchases and purchases of a third or further residential property. These system rules do not promise approval; foreign income, exchange-rate risk and lender policy can be stricter. Confirm what “owning the apartment” legally means
A major trap for foreign buyers is ownership type. Czech apartments are commonly offered either in osobní vlastnictví (personal/freehold ownership, registered directly in the cadastre) or as a družstevní (cooperative) share, which is a membership right in a housing cooperative rather than direct ownership of the unit. A cooperative share cannot be secured by a mortgage over that apartment in the same way as a registered unit, although other financing structures or collateral may sometimes be available. Before you sign
- Hire your own Czech transaction lawyer and arrange an independent translation or interpreter where needed; do not sign a Czech document based only on an agent’s oral summary.
- Confirm ownership type (personal vs. cooperative) before you get attached to a listing — it changes the whole transaction and your financing options.
- Verify the escrow holder and account independently, then state the precise registration evidence, permitted burdens, refund events and long-stop date governing the purchase price.
- If you need a mortgage, get a written pre-approval before making an offer — non-resident underwriting can take longer than the reservation period.
